Terms of Service

Welcome to Roadiyo. These Terms of Service ("Terms") govern your access to and use of the Roadiyo website, platform, and related services (collectively, the "Service") operated by Roadiyo.com ("Roadiyo", "we", "us", or "our").

By accessing or using the Service, you agree to these Terms. Do not use the Service unless you agree to them.

1. About Roadiyo

Roadiyo operates an online directory and discovery platform that helps users find driving instructors and related services.

Roadiyo is a platform provider. Roadiyo does not provide driving lessons, operate as a driving school, or act as the instructor offering services listed on the platform unless expressly stated otherwise on the Service.

2. Eligibility

You must be at least 17 years old to create an account or use the Service.

By using the Service, you represent and warrant that:

you are at least 17 years old
you have the legal capacity to enter into a binding agreement
all information you provide is accurate and current

When you use the Service on behalf of a business or other organization, you represent and warrant that you have authority to bind that entity to these Terms.

3. Accounts

You may need an account to access certain features of the Service.

You are responsible for:

maintaining the confidentiality of your login credentials
all activity that occurs under your account
providing accurate, complete, and current account information
updating your information promptly when it changes

You must not:

create an account using false information
share your account with another person
allow another person to access the Service through your account
attempt to access accounts, systems, or data that do not belong to you

Notify us promptly at support@roadiyo.com when you believe your account has been used without authorization or your login credentials have been compromised.

We may suspend, restrict, or terminate accounts that violate these Terms or create risk for the Service, our users, or third parties.

4. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms.

You must not:

violate any applicable law, regulation, or third-party right
submit false, misleading, fraudulent, or deceptive information
impersonate any person or entity
interfere with the operation or security of the Service
introduce viruses, malware, or other harmful code
scrape, crawl, harvest, copy, or extract data from the Service by automated or unauthorized means
attempt to gain unauthorized access to the Service, accounts, servers, or related systems
use the Service to harass, threaten, abuse, defame, or harm another person
post fake reviews, manipulated ratings, spam, or unauthorized promotional material
reproduce, distribute, modify, or exploit any part of the Service except as permitted by law or by our written consent

5. Listings and Instructor Profiles

The Service contains listings and profiles for driving instructors and related businesses.

Roadiyo may display information supplied by instructors, businesses, users, public sources, or other lawful sources. Instructors may claim listings and edit certain profile content, including images and profile information.

You acknowledge and agree that:

listing information may change at any time
availability, pricing, qualifications, experience, service areas, lesson types, and other details may not always be complete, current, or accurate
you are responsible for independently verifying any instructor, business, or service before booking lessons or relying on any listing information

Roadiyo may edit, refuse, remove, suspend, or reorder listings and profile content at our discretion.

6. Paid Features

Roadiyo offers paid features, which may include promoted listings, featured placements, advertising, subscriptions, profile enhancements, or other paid visibility or platform services.

By purchasing a paid feature, you agree that:

you will provide accurate payment and billing information
you authorize the applicable charges for the selected service
pricing, features, duration, and placement are described at the point of purchase or within the relevant account area
payment obligations are binding once the purchase is completed

Unless Roadiyo states otherwise in writing, fees are non-refundable.

Roadiyo may change pricing, feature availability, packaging, and eligibility for future purchases or renewal periods. Roadiyo may suspend or remove paid features for non-payment, chargebacks, suspected fraud, abuse, or violation of these Terms.

Paid placement, featuring, promotion, or advertising does not constitute an endorsement, certification, or guarantee by Roadiyo.

7. Reviews, Ratings, and User Content

The Service allows users to submit ratings, reviews, comments, profile materials, images, and other content ("User Content").

You are solely responsible for your User Content. By submitting User Content, you represent and warrant that:

you own the content or have all rights needed to submit it
the content is accurate and lawful
reviews and ratings reflect your genuine experience or honest opinion
the content is not false, misleading, defamatory, abusive, hateful, obscene, discriminatory, or invasive of privacy
the content does not infringe any intellectual property, privacy, publicity, contractual, or other rights
the content is not spam or unauthorized advertising

Roadiyo does not guarantee that reviews or ratings are accurate, complete, or representative. Ratings and reviews reflect the views of users, not Roadiyo.

Roadiyo may monitor, moderate, remove, refuse, or edit User Content at our discretion.

By submitting User Content, you grant Roadiyo a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, use, reproduce, adapt, modify, publish, display, distribute, and make available that content in connection with operating, improving, marketing, and providing the Service.

8. Instructor Claims and Edits

When you claim or manage an instructor listing or business profile, you represent and warrant that:

you are the instructor listed or you are authorized to act for that instructor or business
all submitted information, images, credentials, descriptions, and updates are accurate
your content does not violate any law or third-party right
you will maintain your listing information so that it remains accurate and current

Roadiyo may request verification before granting, maintaining, or restoring control over a claimed listing.

Roadiyo may suspend edits, remove content, or revoke claim access where ownership, authorization, accuracy, legality, or policy compliance is in dispute.

9. No Endorsement and No Guarantee

A listing, rating, review, badge, placement, or presence on Roadiyo does not constitute an endorsement, recommendation, guarantee, vetting, certification, or approval by Roadiyo.

Roadiyo makes no promise or guarantee regarding:

the quality, safety, legality, reliability, availability, or suitability of any instructor or service
the truth or accuracy of listing content, credentials, reviews, ratings, or images
lesson outcomes, test outcomes, response times, or user satisfaction
whether any instructor holds valid licenses, approvals, insurance, or qualifications

All decisions to contact, hire, book, or rely on an instructor or business are your own responsibility.

10. Third-Party Dealings

Roadiyo may provide tools that help users contact instructors or businesses, including forms, links, phone details, and profile contact information.

Any communication, agreement, booking, lesson arrangement, payment, dispute, refund request, cancellation, or other dealing between a user and an instructor or business is solely between those parties.

Roadiyo is not a party to those dealings and does not control or assume responsibility for:

the conduct of instructors, businesses, or users
the content of communications between users and third parties
booking arrangements or service delivery
pricing, cancellations, delays, no-shows, refunds, or disputes
personal injury, property damage, financial loss, or other harm arising from third-party conduct or services

11. Intellectual Property

The Service, including its software, design, layout, branding, text, graphics, logos, databases, features, and other content, is owned by or licensed to Roadiyo and is protected by applicable intellectual property laws.

Subject to these Terms, Roadiyo grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.

You must not:

copy, reproduce, republish, distribute, sell, license, or commercially exploit any part of the Service without our written permission
reverse engineer, decompile, or attempt to extract source code from the Service except where the law expressly permits that right
remove or alter copyright, trademark, or proprietary notices

"Roadiyo" and related names, logos, and branding are the property of Roadiyo.com or its licensors.

12. Privacy

Your use of the Service is also subject to our Privacy Policy.

By using the Service, you acknowledge that Roadiyo may collect, use, and disclose information as described in the Privacy Policy.

13. Third-Party Services and Links

The Service may contain links to third-party websites, maps, booking tools, payment processors, social media pages, or other third-party services.

Roadiyo does not control or endorse third-party services and is not responsible for their content, availability, policies, security, or practices. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

14. Service Availability and Changes

Roadiyo may add, modify, suspend, restrict, or discontinue any part of the Service at any time.

Roadiyo does not guarantee that the Service will always be available, uninterrupted, secure, accurate, or error-free.

Roadiyo may update these Terms from time to time by posting the revised version on the Service. Your continued use of the Service after revised Terms are posted constitutes your acceptance of the updated Terms.

15. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Roadiyo disclaims all representations, warranties, and conditions, express, implied, statutory, or collateral, including warranties or conditions of:

merchantability
fitness for a particular purpose
title
non-infringement
accuracy
completeness
reliability
performance
availability
security

Roadiyo does not warrant that:

the Service will meet your requirements or expectations
the Service will be uninterrupted, timely, secure, or error-free
defects will be corrected
the Service or servers are free of viruses or harmful components
any listing, profile, review, rating, or communication is accurate, complete, or current

16. Limitation of Liability

To the fullest extent permitted by law, Roadiyo.com and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, contracts, goodwill, opportunity, data, or anticipated savings, arising out of or relating to:

your use of or inability to use the Service
your reliance on listings, profiles, ratings, reviews, or other content
your dealings with instructors, businesses, users, or third parties
unauthorized access to or use of your account or data
errors, interruptions, bugs, outages, or service failures

To the fullest extent permitted by law, the total aggregate liability of Roadiyo.com arising out of or relating to the Service or these Terms will not exceed the greater of:

the amount you paid to Roadiyo.com in the 12 months before the event giving rise to the claim, or
CAD $100

Nothing in these Terms limits liability where that liability cannot be limited under applicable law.

17. Indemnity

You agree to indemnify, defend, and hold harmless Roadiyo.com and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, actions, demands, proceedings, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to:

your use of the Service
your account
your User Content
your listings, profile edits, images, or submissions
your violation of these Terms
your violation of any law or third-party right

18. Termination

Roadiyo may suspend, restrict, or terminate your access to the Service, remove content, or close your account at any time, with or without notice, where necessary to protect the Service, enforce these Terms, comply with law, address disputes, respond to claims, prevent abuse, or reduce risk.

Upon termination, the rights granted to you under these Terms end immediately. Any provisions that by their nature should survive termination will survive, including provisions relating to ownership, licenses, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law principles.

You agree that the courts located in Alberta, Canada have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms or the Service.

20. General Terms

These Terms, together with the Privacy Policy and any additional terms presented within the Service for specific features, form the entire agreement between you and Roadiyo regarding the Service.

When any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Roadiyo's failure to enforce any provision of these Terms does not waive that provision or any other provision.

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Roadiyo may assign or transfer these Terms and any rights or obligations under them without restriction.
